O caso come\u00e7ou a ser analisado na semana passada, mas um pedido de vista interrompeu o julgamento.<\/p>\n<p>A resolu\u00e7\u00e3o do processo \u00e9 aguardada para pacificar os conflitos criados com o surgimento de novas tecnologia. Em todo o pa\u00eds, os tribunais t\u00eam proferido decis\u00f5es divergentes sobre a quest\u00e3o. Em S\u00e3o Paulo, por exemplo, existem decis\u00f5es que garantiram aos propriet\u00e1rios o direito de alugar o im\u00f3vel por curta temporada. No Rio Grande do Sul h\u00e1 decis\u00f5es contr\u00e1rias aos donos dos im\u00f3veis e a favor dos condom\u00ednios.<\/p>\n<p>O STJ julga um recurso protocolado para anular uma decis\u00e3o do Tribunal de Justi\u00e7a do Rio Grande do Sul (TJ-RS) que proibiu um casal de Porto Alegre de alugar um apartamento por meio do aplicativo Airbnb.<\/p>\n<p>Pela decis\u00e3o do TJ-RS, a falta de v\u00ednculo entre os inquilinos, a alta rotatividade de pessoas, al\u00e9m da reforma no apartamento para criar novos quartos e acomodar mais pessoas caracterizam-se como hospedagem, tipo de atividade comercial proibida pela conven\u00e7\u00e3o do condom\u00ednio.<\/p>\n<p>No recurso, a defesa do casal argumentou que locar quartos n\u00e3o se caracteriza como hospedagem, mas como ocupa\u00e7\u00e3o tempor\u00e1ria. Dessa forma, segundo os advogados, a loca\u00e7\u00e3o por curto espa\u00e7o de tempo, &#8220;com alguma rotatividade de inquilinos&#8221; n\u00e3o configura contrato de hospedagem. Al\u00e9m disso, os ganhos de renda com o valor dos alugu\u00e9is n\u00e3o demonstram que tenha ocorrido explora\u00e7\u00e3o comercial em afronta \u00e0 destina\u00e7\u00e3o residencial do edif\u00edcio.<\/p>\n<p>Ao analisar o caso, o relator do processo, ministro Luis Felipe Salom\u00e3o, entendeu que o condom\u00ednio n\u00e3o pode proibir que os moradores ofere\u00e7am vagas por meio das plataformas digitais. Para o ministro, a proibi\u00e7\u00e3o atinge o direito \u00e0 propriedade e os alugu\u00e9is devem ser enquadrados como loca\u00e7\u00e3o residencial e n\u00e3o como hospedagem.<\/p>\n<p>Ap\u00f3s o voto de Salom\u00e3o, o julgamento foi interrompido por um pedido de vista do ministro Raul Ara\u00fajo. Ainda faltam os votos da ministra Isabel Gallotti e dos ministros Antonio Carlos Ferreira e Marco Buzzi.<\/p>\n<p><strong>Aplicativos de transporte<\/strong><br \/>\nO surgimento de novas tecnologias tamb\u00e9m gerou conflitos entre motoristas de aplicativos e taxistas. No entanto, o caso foi definitivamente decidido em maio deste ano, quando o Supremo Tribunal Federal (STF) decidiu que \u00e9 inconstitucional proibir a atua\u00e7\u00e3o dos motoristas particulares dos aplicativos Uber, Cabify e 99.
