Impeachment n\u00e3o \u00e9 golpe, afirma Celso de Mello, decano do Supremo"},"content":{"rendered":"<p><strong>Marta Nobre, Edi\u00e7\u00e3o<\/strong><\/p>\n<p>Em v\u00eddeo divulgado no Youtube, o ministro Celso de Mello, decano no Supremo Tribunal Federal, afirmou que a figura do impeachment \u00e9 instrumento previsto na Constitui\u00e7\u00e3o democr\u00e1tica brasileira e n\u00e3o pode ser reduzido \u00e0 condi\u00e7\u00e3o de &#8220;mero golpe&#8221;.<\/p>\n<p>&#8220;A figura do impeachment n\u00e3o pode ser reduzida \u00e0 condi\u00e7\u00e3o de um mero golpe de estado porque o impeachment \u00e9 um instrumento previsto na Constitui\u00e7\u00e3o, uma Constitui\u00e7\u00e3o democr\u00e1tica, que est\u00e1 em vigor no pa\u00eds e que estabelece regras b\u00e1sicas&#8221;, disse o ministro, ao ser questionado sobre o assunto em um shopping. &#8220;Se essas regras b\u00e1sicas forem respeitadas, obviamente o impeachment n\u00e3o pode ser considerado um ato de arb\u00edtrio pol\u00edtico e de viol\u00eancia pol\u00edtica&#8221;, completou.<\/p>\n<p>Mello \u00e9 o terceiro ministro do Supremo a defender publicamente nesta semana a constitucionalidade da figura do impeachment de um presidente da Rep\u00fablica e refutar a tese de que o instrumento em si n\u00e3o pode ser considerado golpe. O discurso \u00e9 recorrente entre os defensores da manuten\u00e7\u00e3o da presidente Dilma Rousseff no cargo. A pr\u00f3pria presidente chegou a fazer esta afirma\u00e7\u00e3o.<\/p>\n<p>Na quarta-feira, 23, a ministra C\u00e1rmen L\u00facia comentou as declara\u00e7\u00f5es de Dilma sobre o assunto. &#8220;N\u00e3o acredito que a presidente tenha falado que impeachment \u00e9 golpe. Impeachment \u00e9 um instituto previsto constitucionalmente&#8221;, disse ela. &#8220;O que n\u00e3o pode acontecer de jeito nenhum \u00e9 impeachment nem ou qualquer tipo de processo pol\u00edtico-penal ou penal sem observar as regras constitucionais. N\u00e3o h\u00e1 impeachment em andamento ainda, n\u00e3o tenho nenhuma d\u00favida que teremos que observar todas as regras constitucionais&#8221;, completou.<\/p>\n<p>No mesmo dia, o ministro Dias Toffoli afirmou que o processo de impeachment \u00e9 previsto na Constitui\u00e7\u00e3o e nas leis brasileiras, mas n\u00e3o quis opinar sobre o caso espec\u00edfico da presidente Dilma Rousseff.<\/p>\n<p>O v\u00eddeo com Celso de Mello foi postado na quinta-feira, 24. Ele afirma que suas respostas est\u00e3o de acordo com posicionamentos j\u00e1 dados por ele em julgamentos no Supremo Tribunal Federal. Segundo ele, o impeachment \u00e9 um instrumento leg\u00edtimo pelo qual se objetiva responsabiliza\u00e7\u00e3o pol\u00edtica de qualquer presidente da Rep\u00fablica, independente de sua filia\u00e7\u00e3o partid\u00e1ria. &#8220;\u00c9 um instrumento posto \u00e0 disposi\u00e7\u00e3o da cidadania. Porque s\u00f3 o cidad\u00e3o, o eleitor, \u00e9 que quem legitimidade para provocar a abertura do processo do impeachment. \u00c9 o que diz claramente a lei&#8221;, disse.<\/p>\n<p>Questionado sobre decis\u00e3o do ministro Teori Zavaski de ordenar o encaminhamento ao STF da investiga\u00e7\u00e3o sobre o ex-presidente Luiz In\u00e1cio Lula da Silva, Mello disse que ela foi &#8220;tecnicamente correta e juridicamente adequada&#8221;. &#8220;A decis\u00e3o est\u00e1 de acordo com a jurisprud\u00eancia no STF j\u00e1 sacramentada em outros casos, outras pessoas e contexto diversos&#8221;, disse ele, lembrando que a determina\u00e7\u00e3o \u00e9 provis\u00f3ria e ser\u00e1 analisada pelo plen\u00e1rio da Corte.<\/p>\n<p>Ao ser questionado sobre recentes declara\u00e7\u00f5es do ex-presidente Luiz In\u00e1cio Lula da Silva, de que a opera\u00e7\u00e3o Lava Jato teria sido a causadora de &#8220;efeitos econ\u00f4micos negativos&#8221;, o ministro respondeu: &#8220;o juiz (S\u00e9rgio) Moro vem agindo de acordo com o que manda a legisla\u00e7\u00e3o brasileira.
